If you are interested in the truth, here are facts that conclusively prove that Chris Hill’s allegations that Lynne Finley “abandoned her official position for six months in 2020” is 100% false and malicious.

Chris Hill has repeatedly accused District Clerk Lynne Finley of “abandoning” her office as the Collin County District Clerk and performing no work as the Collin County District Clerk from March 10, 2020 – September 14, 2020.

Lynne Finley actively worked as the Collin County District Clerk virtually every day between March 10, 2020 and September 14, 2020.

Lynne Finley, along with more than half the employees of the Collin County District Clerk’s Office, worked remotely during parts of the Covid 19 crisis, in accordance with the orders of both the Texas Supreme Court and the Administrative Law Judge of Collin County.

On March 13th, 2020, the Texas Supreme Court issued its FIRST EMERGENCY ORDER REGARDING THE COVID-19 STATE OF DISASTER. The order provided, in part, 

“…that all courts in Texas may in any case, civil or criminal—and must to avoid risk to court staff, parties, attorneys, jurors, and the public… require anyone involved in any hearing, deposition, or other proceeding of any kind… to participate remotely, such as by teleconferencing, videoconferencing, or other means;”

The Collin County Local Administrative Judge supplemented the Texas Supreme Court Order with a local order and COVID-19 Operating Plan for the Collin County Court System that provided, in part

“… All judges will use all reasonable efforts to conduct proceedings remotely.” and

“…Judges and court staff who can perform the essential functions of their job remotely will telework when possible.”

Between March 10, 2020 and Sept. 14, 2020 Lynne Finley handled 6,329 emails using her official Collin County email account in the performance of her duties as the Collin County District Clerk.

Between March 10, 2020 and Sept. 14, 2020 Lynne Finley handled more than 530 phone calls and Zoom conferences in the performance of her duties as the Collin County District Clerk, including weekly supervisor meetings and employee conferences.

On May 15th, 2022 Lynne Finley sent an email to the Collin County IT Department

officially requesting a summary of the emails that she had sent or reviewed in the performance of her duties as the Collin County District Clerk between March 10, 2020 and Sept. 14, 2020 using her official Collin County District Clerk email account.

The Collin County IT Department identified 804 emails that Lynne Finley sent in the performance of her duties as the Collin County District Clerk between March 10, 2020 and Sept. 14, 2020 using her official Collin County District Clerk email account.

The Collin County IT Department identified 5,525 emails that Lynne Finley reviewed in the performance of her duties as the Collin County District Clerk between March 10, 2020 and Sept. 14, 2020 using her official Collin County District Clerk email account.

On May 16th, 2022, Caren Skipworth, the head of the Collin County IT Department sent Lynne Finley an email stating according to official Collin County records, Lynne Finley sent 804 emails and reviewed 5,525 emails in the performance of her duties as the Collin County District Clerk between March 10, 2020 and Sept. 14, 2020 using her official Collin County District Clerk email account.

Chris Hill had the above information in his possession at the time he falsely accused District Clerk Lynne Finley of “abandoning” her office as the Collin County District Clerk and performing no work as the Collin County District Clerk from March 10, 2020 to September 14, 2020.

I will post facts and evidence to address Chris Hill’s other false accusations shortly.

Chris Hill has made so many false allegations, it takes a considerable amount of time to gather documentation of the truth.

Chris Hill’s Accusations about Lynne’s Mortgage

Chris Hill is making more false allegations against Collin County District Clerk Lynne Finley.

This time he is accusing Lynne of refusing to pay her mortgage for 7 years. 

The truth is simple, but gathering evidence is time consuming. 

Here is a summary until a more comprehensive explanation with supporting documents can be posted.

Lynne took out a home equity loan from a mortgage company named Taylor Bean and Whitaker (TBW).

TBW put mortgages, including Lynne’s, into mortgage-backed securities and used them as collateral to get loans.

TBW used mortgages and mortgage backed securities as collateral for multiple loans at the same time, when TBW had already committed or sold those mortgages and/or mortgage backed securities to other third-party investors. 

TBW engaged in sham sales of groups of mortgage loans, known as “pools,” that other entities already owned to Colonial Bank. As a result, false information was entered on Colonial Bank’s books and records.

TBW’s fraudulent activities contributed to the failure of Colonial Bank, resulting in a $3.8 billion loss.

TBW CEO and several officers were convicted of fraud and other mortgage related offenses and sentenced to federal prison. TBW went bankrupt.

Tens of thousands of TBW loans, including Lynne’s, had either been sold to multiple buyers, or pledged to multiple lenders, ALL of whom claimed to own the right to collect on those mortgages. 

After the TBW bankruptcy, Lynne was contacted by three separate financial institutions who all claimed to have the legal right to collect on her loan. 

Lynne informed the financial institutions, in writing, that she would not make any further payments on the loan until the issue of which institution was actually  entitled to collect on the loan was resolved.

Eventually one of the financial institutions, Nationstar, threatened to file a lawsuit against Lynne seeking to foreclose on her home. At the time that Nationstar threatened to foreclose on her home, there was no record of Nationstar having any interest in Lynne’s home filed in the Collin County property records. Nationstar later testified that it never actually obtained an ownership interest in the loan, and they believed Freddie Mac owned the loan. 

Nationstar let their lawsuit to foreclose on Lynne’s home sit idle for almost 3 years. Nationstar’s lawsuit against Lynne was ultimately dismissed.

When a fourth financial institution also claimed a right to collect on Lynne’s home equity loan, Lynne sued that financial institution in order to have a Court determine who had the actual legal right to enforce the lien associated with the home equity loan. That lawsuit is the lawsuit Chris Hill made his accusations about. 

TBW’s fraud was not limited to defrauding banks and the government out of hundreds of millions of dollars. TBW also falsified loan documents in the process of creating home equity loans, including documents involved in Lynne’s home equity loan. As a result of TBW’s fraud, not only is it uncertain who has the right to collect on Lynne’s loan, but the loan itself fails to comply with the requirements of the Texas Constitution, and is therefore legally unenforceable. 

The financial institution in the current lawsuit has not:

 – loaned ANY money to Lynne.

 – paid off ANY loans associated with Lynne’s home.

Chris Hill is intentionally misrepresenting the nature of the lawsuit.

Why is County Judge Chris Hill attacking Collin County District Clerk Lynne Finley?

Many of you are asking me why Collin County Judge Chris Hill is abusing his office by using his official channels of communication to publically attack my wife, the Collin County District Clerk, on Facebook, Nextdoor and several other social media sites. 

I am obviously biased when it comes to Judge Hill, so I will let former Collin County Judge John Payton provide you with the truth about just some of Collin County Judge Chris Hill’s misconduct. I assure you that what you are about to read is the tip of the iceberg.
